General Terms and Conditions (GTC)
Transport Quality Service Michele Civetta - TECH-DRIVE.CH
1. Scope of application
These GTC govern the contractual relationship between Transport Quality Service Michele Civetta and learner drivers. They apply to all services and contracts that are provided as part of the driving school's driving training. Deviating terms and conditions of the learner driver shall not apply unless they have been expressly recognized in writing by the driving school.
2. Registration and conclusion of contract
- Registration for driver training takes place by contacting the driving school in person, by telephone or electronically and becomes binding upon confirmation by the driving school.
- The driving training contract is concluded as soon as the driving school confirms the registration. The confirmation can be made verbally, in writing or electronically.
3. Participation requirements
- The learner driver must be in possession of a valid learner's license before practical driving lessons can begin.
- The learner driver must be in good health and physically fit to drive a vehicle and must not be under the influence of alcohol, drugs or medication that could impair their ability to drive during the driving lessons.
4. Driving lessons
- Driving lessons are arranged by agreement with the driving instructor or driving school.
- Agreed driving lessons are binding. Cancellations or postponements must be made at least 24 hours in advance. If a cancellation is not made in due time, the full fee for the missed driving lesson will be charged.
- If the learner driver is late, the agreed driving lesson is deemed to have been completed in full.
5. Terms of payment
- The fees for driving lessons, theory lessons and other services are due in advance or by agreement.
- The current prices for driving instruction and additional services can be found in the driving school's price list. We reserve the right to change the fees.
- In the event of late payment, the driving school reserves the right to suspend further driving lessons or services until the outstanding amounts have been settled.
6. Examination requirements
- The driving school prepares the learner driver for the theoretical and practical driving test. Registration for the practical test takes place in consultation with the driving school as soon as the driving instructor considers the learner to be ready for the test.
- The prerequisite for registering for the practical test is the successful completion of the theory lessons and the achievement of a sufficient level of training in the practical driving training.
7. Liability
- The driving school is only liable for damage caused intentionally or through gross negligence on the part of the driving instructor. The learner is liable for any damage caused by the learner during the driving lessons.
- During the driving lessons, the learner driver is adequately insured by the driving school. The learner driver must take out their own insurance for private driving lessons.
8. rules of conduct
- The learner driver undertakes to follow the instructions of the driving instructor during the driving lessons.
- The driving school reserves the right to terminate the training contract without notice in the event of gross misconduct, in particular disregard of traffic rules or instructions from the driving instructor.
9. Data protection
- The driving school collects and stores personal data of the learner driver exclusively for the fulfillment of contractual obligations. The data will not be passed on to third parties unless this is necessary for the fulfillment of the contract or required by law.
10. termination of the contract
- The contract can be terminated in writing by either party at any time.
- Any driving lessons already paid for but not taken will be refunded. If the learner driver fails to fulfill contractual obligations, the driving school reserves the right to terminate the contract without notice.
11. severability clause
- Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
12. place of jurisdiction
- The place of jurisdiction for all disputes arising from the contractual relationship is the registered office of the driving school.
